Former Marine Daniel Penny, 24, surrendered to the New York Police Department’s 5th Precinct in lower Manhattan on Friday morning. He is being held accountable for the death of Jordan Neely who was killed by a chokehold during an altercation in a subway station earlier this week.
The incident occurred when Neely and his friends attempted to enter the train without paying their fare. It is reported that Penny intervened after seeing what he believed to be suspicious behavior from one of Neely’s companions and attempted to restrain him with a chokehold, which resulted in his death shortly afterward due to asphyxiation.
Penny has been charged with second-degree manslaughter and could face up to 15 years imprisonment if convicted at trial or plea bargain down depending on how prosecutors choose to proceed with their case against him. His attorney released a statement saying “Mr Penny acted out of self-defense believing he was protecting himself from imminent danger.” The NYPD is still investigating this matter but has not yet commented further about it publicly beyond confirming that they have taken Mr. Penny into custody over these allegations so far.
